Privacy Policy

We obtain information about you through the means discussed below when you use the Services (“Collected Information”). Please note that we need certain types of information so that we can provide the Services to you. If you do not provide us with such information, or ask us to delete it, you may no longer be able to access or use part or all of our Service.

A. Information That You Provide To Us.

We collect a variety of information that you provide directly to us, including without limitation: name, physical address, telephone number, email address, medical conditions, treatment options, physician referrals, lifestyle and personal preferences, prescriptions, and lab results or other related health information, such as your physical and emotional characteristics, billing information, such as shipping address, credit or debit card number, verification number, expiration date, and identity verification information (e.g., driver’s license or other identifier), account log-in credentials and other account information, your customer service and maintenance interactions with us, demographic information collected in connection with the Services, emergency contact information, and any other information provided by you in connection with your access to and use of the Services.

B. Other Information Collected.

Like many other websites, when you use our Site, we may collect and analyze information such as your IP address, browser types, browser language, operating system, the state or country from which you accessed the Services, software and hardware attributes (including device IDs) referring and exit pages and URLs, platform type, the number of clicks, files you download, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the terms you use in searches on our sites, the date and time you used the Services, error logs, and other similar information. We may combine this information with other information that we have collected about you, including, where applicable, your user name, name, and other personal information. If you access PillTabs through our app, we automatically receive certain information about the mobile phone, tablet, or computer used to access the app, including a mobile device identifier, advertising identifiers (in accordance with your device settings), IP address, operating system, version, internet service provider, browser type, domain name and other similar information, whether and when you update the apps, date and time of use, and how you use the apps, including time spent in different portions of the apps.

When you use the Services, we and our service providers may automatically collect general location information (e.g., IP address, city/state and or postal code associated with an IP address) from your computer or mobile device. This information allows us to enable access to content that varies based on a user’s general location (e.g., to provide you with accurate sales tax information and to deliver content customized to your location).

Before collecting GPS location information, we will obtain your consent. In such instances, we will use your precise geo-location information to provide customized services, content, promotional offers and other information that may be of interest to you. If you no longer wish for us and our service providers to collect and use GPS location information, you may disable the location features on your device. Please see your device manufacturer’s user manual for guidance on how to disable this feature on your device.

C. Cookies.

Certain features of the Site are only available through the use of cookies and other user tracking mechanisms (collectively, “Cookies”). Cookies may include small files saved on your local hard drive which store your preferences or other records, and enable PillTabs to (a) collect information about your use of the Site, (b) understand general Site usage and volume statistical information, and (c) improve the services, experience, content and offerings on the Site. Please note that you can change your settings to notify you when a cookie is being set or updated, or to block cookies altogether, however, if you do so, you may lose some functionality on the Site or not be able to use certain features on the Site that require the use of Cookies.

We may also use automated devices and applications, such as Google, Facebook, Instagram and similar companies, to evaluate usage of our Site and to help us personalize content. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use Cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.

A. In Connection with Services.

In order to provide you with Services, we may use the Collected Information in the following ways: verify your identity, administer your account, facilitate the provision of health care services to you by physicians or other health care providers, process payments, fulfil orders, communicate regarding the Services, inquiries related to the Services, by email, postal mail, or phone regarding Services, products, surveys, or promotions, technical support, and customer service. We may also use the Collected Information to establish, exercise, or defend our legal rights and as where necessary to comply with all applicable laws, and regulations.

B. Sharing of Collected Information.

PillTabs may disclose your Collected Information to certain third party providers for business purposes. They provide a variety of services to us, including billing, sales, marketing, advertising, analytics, research, customer service, shipping and fulfillment, data storage, IT and security, fraud prevention, payment processing, and auditing and legal services. These entities may also include health care organizations, pharmacies, and other third parties we use to support our business or in connection with the administration and support of the Services. In the event that we disclose Collected Information for these purposes, such disclosure will be subject to a confidentiality and non-disclosure agreement as between PillTabs and the third party provider so that the recipient is required to both keep the Collected Information confidential and to not use it for any purpose except for the purposes set forth in its contract with PillTabs.

PillTabs may also share aggregate or de-identified information (i.e. information that does not personally identify you) without restriction, subject to applicable law. This may include, without limitation, sharing information with third parties for marketing, advertising, research or other purposes.

By using the Services, you acknowledge and agree that we may access, retain and disclose the information we collect and maintain about you if required to do so by law or in a good faith belief that such access, retention or disclosure is reasonably necessary to: (a) comply with legal process (e.g. a subpoena or court order); (b) enforce our Terms of Use, this Privacy Policy, or other contracts with you, including investigation of potential violations thereof; (c) respond to claims that any content violates the rights of third parties; (d) respond to your requests for customer service; and/or (e) protect the rights, property or personal safety of PillTabs, its agents and affiliates, its users and/or the public. This includes exchanging information with other companies and organizations for fraud protection, and spam/malware prevention, and similar purposes.

We utilize technical, physical, administrative and organizational safeguards to protect personal information from loss, misuse, unauthorized access, disclosure, alteration and destruction. While we take extensive measures to protect your personally identifiable information, it cannot ensure or guarantee the security of any information you transmit to PillTabs or through the Site. PILLTABS DOES NOT COVENANT, REPRESENT, OR WARRANT THAT THE TRANSMISSION OF YOUR HEALTH INFORMATION WILL NOT BE COMPROMISED.

By providing an email address to PillTabs, either on the Site or otherwise in connection with the Services, you agree that we may contact you to provide you with any Service related notices, to provide you with information about our events, invitations, or related educational information, or in the event of a change in this Privacy Policy. You may stop receiving marketing emails from PillTabs by clicking the unsubscribe link included at the bottom of any PillTabs marketing email. You cannot opt out of certain emails we need to send you relating to normal business operations (for example, notifying you of a message from your healthcare provider). To opt out of all emails from PillTabs, you may email service@pilltabs.com and cancel your membership.

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our website for third party purposes, and that is why we provide the variety of opt-out mechanisms listed above. Currently, however, we do not recognize or respond to browser-initiated DNT signals.

Our Site is not intended for children under 13 years of age. We do not intentionally gather Personal Information about visitors who are under the age of 13. If a child has provided us with Personal Information, a parent or guardian of that child may contact us to have the information deleted from our records. If you believe that we might have any information from a child under age 13 in an applicable jurisdiction, please contact us at service@pilltabs.com. If we learn that we have inadvertently collected the personal information of a child under 13, or equivalent minimum age depending on jurisdiction, we will take steps to delete the information as soon as possible.

We retain Collected Information on the basis of the amount, nature and sensitivity of your Personal Information processed, the potential risk of harm from unauthorized use or disclosure of your Personal Information and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation). After expiry of the applicable retention periods, the Collected Information will be deleted. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use of such data.

Our Site may contain links to other websites. We do not control such websites and are not responsible for their contents or the privacy policies or other practices of such websites. Our inclusion of links to such websites does not imply any endorsement of the material on such websites or any association with their operators. The information practices and the content of such other websites are governed by the privacy statements of such other websites. A. To the extent that PillTabs or its owner(s) and/or affiliates is a “covered entity” under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) each such covered entity has privacy and security obligations with respect to protected health information (“PHI”). For more information regarding your rights under HIPAA, see http://www.hhs.gov/ocr/privacy.

B. To the extent PillTabs is a “business associate” under HIPAA, we have agreements in place with healthcare providers requiring us to only use and disclose PHI as the healthcare providers are permitted to under HIPAA. This Privacy Policy and the privacy and security practices described therein are designed to comply with these agreements. As such, among other obligations, we will:

• Use reasonable and appropriate safeguards to keep your PHI that we collect private and confidential;
• Alert you in accordance with the guidelines set forth under HIPAA if we are made aware of any unauthorized access to your PHI that we have collected; and
• Provide you access in a reasonable time and manner to your PHI we have collected and make any reasonably requested amendment thereto.

PillTabs may de-identify PHI pursuant to HIPAA and aggregate patients’ de-identified information with other Collected Information, and use such aggregated information for population-based research activities and analytics and/or treatment, payment, enrollment, or eligibility for benefits that are not conditioned upon the user/patient reviewing the privacy policy. When information is used or disclosed, it may be subject to re-disclosure and may no longer be protected by state or federal privacy regulations.

The California Consumer Privacy Act (“CCPA”) requires us to provide California residents with additional information on how we collect, use, and share “personal information” (as defined in the CCPA).

A. Categories of Collected Information.

Pursuant to the CCPA, we must share with you the categories of personal information that we collect from you and others. The categories of personal information that we collect are as follows: identifiers (such as name, address, email address); commercial information (such as transaction data); financial data (such as credit card information); internet or other network or device activity (such as IP address); general geolocation information; legally protected classifications (we only collect your gender); medical information; physical characteristics or description; and other information that identifies or can be reasonably associated with you.

B. How we use and share these categories of personal information.

We use and share the categories of personal information we collect from and about you consistent with the various business purposes we discuss throughout this Privacy Policy. Please note that the CCPA sets forth certain obligations for businesses that “sell” personal information to third parties. We do not sell your personal information in exchange for money.

C. CCPA Rights Regarding Disclosure.

The CCPA allows California residents to make certain requests of PillTabs with regard to their personal information. Specifically, California residents may request:

• Information about the categories of personal information collected or disclosed, the categories of sources of such information; the business or commercial purpose for collecting such information, and the categories of third parties with whom such personal information is disclosed.
• Provide access to and/or a copy of certain information we hold about you.
• Delete certain information we have about you.
• The CCPA further provides you with the right to not be discriminated against (as provided for in applicable law) for exercising your rights.

Notwithstanding the foregoing, certain information may be exempt from such requests under California law. For example, we need certain information in order to provide the Services to you. We also will take reasonable steps to verify your identity before responding to a request.

D. Category of Personal Information.

• Identifiers and contact information (e.g., name, address, email address, account names);
• Service providers, payment processors, our affiliates, health care providers and services, entities for legal and fraud prevention;
• Commercial and transactional information (e.g., information about your purchases);
• Financial information (e.g., credit card info collected by our payment processors);
• Internet or other network or device activity (e.g., IP address, browsing history, app usage);
• Geolocation information (e.g., general location and precise location, with your permission);
• Demographic and statistical data (e.g., your gender, interests based on products and services you use);
• Physical characteristics (e.g., photos of you);
• User-generated content (e.g., information you choose to post in our online forums);
• Customer service data (e.g., information you provide through a chat or call with the PillTabs team);

Please provide your full name, email address and the physical mailing address associated with your use of our Services, along with your request, so that we can process your request efficiently. If you would like to receive a copy of your medical record in connection with your request, please indicate that in your email message. By requesting your medical record in this way, you are agreeing to receive your medical record in an unencrypted email message.

Shine the Light Disclosure.

The California “Shine the Light” law allows California residents the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information with third parties for their direct marketing purposes. We do not share your personal information with third parties for their own direct marketing purposes.

Pursuant to Nevada law, certain Nevada consumers may opt out of the sale of “personally identifiable information” for monetary consideration (as such terms are defined under Nevada law) to a person for that person to license or sell such information to additional persons. We do not engage in such activity; however, if you are a Nevada resident who has purchased services from us, you may submit a request to opt out of any potential future sales under Nevada law by emailing us at service@pilltabs.com. Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.

Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services or programs, email notification of privacy policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review.
